
About the Role
Elastic is seeking an innovative Corporate Counsel to help shape how our technologies are built, protected, and brought to market. As a distributed-by-design company, this role is open to candidates in the United States or Canada. You will report to the Vice President of Legal Innovation and work closely with product and engineering teams from ideation through launch.
Key Responsibilities
- Patent Prosecution & Invention Harvesting: Support day-to-day patent prosecution, manage invention harvesting programs, and collaborate with outside counsel to prioritize IP filings.
- IP Portfolio Management: Assist in managing global patent, copyright, and trademark portfolios, including clearance, registrations, and deadline tracking.
- Brand Protection: Support enforcement strategies, including domain name disputes and social media takedowns.
- Product Regulatory Governance: Coordinate with Privacy, Commercial, and InfoSec teams to ensure product launch readiness and compliance.
- Open-Source & Product Counseling: Manage open-source software licensing and compliance; provide guidance on AI model licensing and data usage risks.
- Commercial Contracts: Draft and negotiate commercial contract clauses related to AI, IP, and open-source software.
- Trade Compliance: Develop foundational knowledge of export laws (EAR) and provide backup support to the trade compliance team.
What You Bring
- Experience: 2–5+ years in patent prosecution, litigation, or IP/product law, preferably within the software, SaaS, or enterprise data platform industry.
- Technical Background: Bachelor’s or advanced degree in a science or engineering field; software engineering background is a strong plus.
- Credentials: Admission to the US or Canadian Patent Bar (registration number required). JD or LLB preferred; patent agents are eligible.
- Skills: Demonstrated ability to translate complex technical concepts into clear patent claims and legal analysis.
- Mindset: Proactive, self-starting, and curious about Generative AI and the legal frameworks governing code and data.
